PETOKOLONAŠKA KLIKA ODBIJA IDEJU GRAĐANSKOG DRUŠTVA I DEMOKRATSKE DRŽAVE BOSNE I HERCEGOVINE |

je s kojim bolesnim likovanjem i populističkim ushićenjem u javnosti glasnici
nekontrolirane mržnje i stranačke ostrašćenosti napadaju člana Predsjedništva
BH Željka Komšića i dr. Slavena Kovačevića, jer je Evropski sud za ljudska
prava osporio “status aplikanta” dr. Slavena Kovačevića. Kontekst diskriminacije građana BiH Moguće je, naravno,
navesti samo neke osnove crte konteksta u kojem se odvija proces pred
Evropskim sudom za ljudska prava u predmetu dr. Kovačević v. BiH. Pred
očima javnosti u kojoj živimo događa se etnička getoizacija Bošnjaka, Hrvata
i Srba na uskom prostoru Bosne, a to je opasna politika izolacionizma; u toku
je cancel culture, pauperizacija i rastući analfabetizam
stanovništva; isto tako, nastavlja se proces migracija i demografska
regresija, samoubilački se odvija svođenje nacionalnosti na
etničko-religijsku grupu, odbacuje se racionalnost Moderne i usiljeno
natura primordijalnost, primitivizam i predpolitički barbarski mentalitet.
Agresivnost velikosrpskog i velikohrvatskog hegemonijskog nacionalizma
nepojmljiva je bosanskom političkom subjektu još uronjenom u prazninu
jugonostalgije koja je veliki lonac za kuhanje bosanskog mozga. Političari EU
i dalje pričaju bajke za naivne! Slaven Kovačević je
aplikacijom pred Evropskim sudom za ljudska prava (ESLJP) stao na liniju
fronta protiv diskriminacije, nepravde, nacijskih hegemonista,
konsocijacijskih sveštenika, etnokrata, patokrata, idiokrata, vazala i
diletanata petokolonaškog mehanizma, religijskih fundamentalista, ciničke
birokratije, egocentričkih manijaka tzv. “legitimnog predstavljanja” i lažnih
proroka “konstitutivnih naroda”. Boreći se za prava svih građana BiH i
ublažavanje posljedica genocida i ratnih progona dr. Kovačević je otvorio put
i pokazao pravac izlaska iz mraka, ali i otkrio je brojne čuvare aparthejda i
diskriminacije. Time je direktno udario u tvrđavu tuđmanizma koja već
decenijama napada bosanski državni okvir, svodeći bosansku državu na
provizorni “krajolik” bez bitnih znakova postojanja. Na slučaju Kovačević se
vidjelo da etnopolitika ili većina političara u BiH nije svjesna povijesnog
trenutka u kojem se nalazi država Bosna i Hercegovina. Kovačević traži da
svaki građanin Bosne i Hercegovine može birati sve članove Predsjedništva
BiH. Veliko vijeće ESLJP
obznanilo je operativne zaključke u predmetu dr. Kovačević – ne presudu. U
stavu 1. operativnih zaključaka kazuje se da je aplikant pred ESLJP dr.
Kovačević “osporavao prirodu indirektnih izbora za Dom naroda BiH kako je
utvrđeno Izbornim zakonom i nametnutim odredbama Visokog predstavnika iz
oktobra 2022. godine”. Ali, to uopće nije bio Kovačevićev tužbeni zahtjev u
aplikaciji. Dakle, konstatacija velikog vijeća ESLJP ne odnosi se na ono što
u aplikaciji dr. Kovačevića stoji! Čini se da je cilj difamirati i
diskreditirati dr. Kovačevića! Šta
se pokazuje kao bitno uz sudsko bavljenje “proceduralnim pitanjima” Prije
svega, treba upozoriti, dr. Kovačević je u
svojoj aplikaciji osporavao odredbe Ustava Bosne i Hercegovine (član 4.1 i
član 5.), kojim se onemogućava ostvarivanje aktivnog biračkog prava građanima
u izborima za Predsjedništvo Bosne i Hercegovine i Dom naroda Bosne i
Hercegovine. Prvostepena Presuda ESLJP je potvrdila tu činjenicu u avgustu
2023. Pristajanje na evidentnu diskriminaciju građana BiH znači da
antibosanske snage žele držati građane BiH zakovane u etničkoj podjeli i
teritorijalnoj getoiziranosti. To je osnova da bi se u budućnosti moglo
govoriti o srpskim i hrvatskim “teritorijama” u Bosni, a onda dosljedno tome
i bošnjačkim. Nema potrebe za demokratijom! Na taj način se ne govori o Bosni
kao jedinstvenoj državi nego o “tronarodnoj” getoiziranoj zajednici koja
poništava vlastitu nacionalnost i svodi je na etničko-religijske grupe i
njihove lidere. Građanin ima prava samo u svome etničkom getu kao pripadnik
jedne narodne grupe i tu može glasati za svoga etničkog lidera. Nužno je,
zbog toga, tražiti izlaz iz dejtonskog ustavnog aranžmana i
zarobljenosti u aparthejd. Zatim, drugo, u nadama tuđmanizma, poništavanje prethodne presude u slučaju dr. Kovačević, otvara put za nametanje “legitimnog predstavljanja i “izbornog zakona” po etničko-religijskom modelu HDZ-a kao definitivnog političkog oblika. Na taj način se Bosna pretvara u tri odvojene etničke republike pod vlašću vođa naroda i postaje disfunkcionalna. Svaka kritika etničkih lidera proglašava se nedomoljubnim činom i gotovo izdajničkim ponašanjem. Vođa je neupitan! Treće, tzv. “international community” (IC), koja je tigar od papira i predstavlja se kao zaštitnik interesa države BiH, samo će u jednom času da nestane s horizonta i ostavi građane BiH na vjetrometini. OHR danas ne radi svoj posao kako treba i postao je indikator kako IC drži do države Bosne i Hercegovine. HR Schmidt je kolonijalnim manirom maharadže 2. oktobra 2022. poništio bošnjački narod i ustav BiH na jedan dan da bi otvorio prostor/prolaz HDZ-ovom zahtjevu za etničkom podjelom državnog prostora. Jasno je da je “ovaj dio Evrope” ostavljen na vjetrometini fašističkih projekata hegemonije iz susjedstva. Na sličan način je IC ostavila Bosance u Srebrenici 1995. pred koljačkim hordama ratnog zločinca Mladića. Ostavljeni na vjetrometini su u velikoj opasnosti! Četvrto, nužno je što prije razviti projekt vlastite političke, ekonomske, znanstveno-tehnološke, bosanske samoopstojnosti koji će biti odgovor na evropski cinički pokušaj etničke podjele BiH. Zato je bitno pitanje naše budućnosti nacionalnost i suverenitet, odnosno bosanski etatizam. Vjerovatno će domaći politički diletanti i sveštenici sultanata shvatiti da bez bosanske nacionalnosti nema nikakve budućnosti. Narodna kulturna forma u ovom vremenu mora imati nacionalni okvir u kojem se preko države održava opstanak. To znači da religija ne daje naciju! Peto, hrvatska politika iz Zagreba na čelu s Plenkovićevim hadezeovskim odnosom prema Bosni ne skriva da je zadovoljna poništenjem prethodne presude i da sada aktivno napada na Izborni zakon BiH koji će služiti politici Dragana Čovića i nastavku tuđmanizma u Bosni. (“U pogledu Bosne i Hercegovine, ključno pitanje je donošenje izborne reforme radi jednakopravnosti svih triju konstitutivnih naroda, kao i funkcionalnosti zemlje. Iskorak koji je BiH ostvarila otvaranjem pristupnih pregovora treba biti poticaj političkim akterima da provedu reforme koje su važne za bolji život građana i ubrzanje integracijskog procesa”, kazuje Plenković.) Plenković i dalje valja tuđmanizam i “legitimno etničko predstavljanje”, pokušavajući Bosnu zalediti u stanju etnopolitike, “tronarodne” konsocijacijske zajednice, koja rezultira etničkim teritorijama i trajnom kontrolom bosanskog prostora od strane susjednih država, Srbije i Hrvatske. Fabrikovanje novog pravnog stanja ESLJP je u prethodnim
pravosnažnim presudama (Zornić, Pudarić, Pilav, Šlaku i Sejdić-Finci) utvrdio
da je izborni sistem u Bosni i Hercegovini zasnovan na etničkim i
teritorijalnim kriterijima, te je stoga diskriminatoran i mora biti detaljno
izmijenjen u skladu s evropskim pravnim standardima. Aktuelni operativni zakjučci
ESLJP stvaraju mehanički jednu novu vještačku pravnu situaciju koja uopće
nije predmet tužbenog zahtjeva dr. Kovačevića u njegovoj aplikaciji. Na taj
način, uz “veliki, veliki, veliki izuzetak” kao pokrivač pripremljenih
zaključaka, ESLJP proizvodi novu pravnu situaciju koja omogućuje negiranje
“statusa žrtve” i pretvaranje dr. Kovačevića u manipulatora, jer nije
koristio domaće “pravne lijekove”. Sada je potrebno samo malo logike. Ako
imamo u vidu da ESLJP donosi zaključke koji nemaju uporište u tužbenom
zahtjevu dr. Kovačevića, onda je sasvim jasno da se radi o namjeri da se
predmet obori, bilo u korist HDZ-a koji vodi cjelokupnu operaciju “brige za
BiH” ili interesa države Hrvatske koja preko VP Schmidta nastoji nametnuti
“izborni zakon” i “legitimno predstavljanje” po vlastitoj mjeri u BiH.
Pojavljuje se opravdano pitanje: da li Bosna i Hercegovina može uživati
demokratiju u punom smislu riječi kao druge evropske države? Možda neko misli
da BiH ne treba uopće demokratija – nego aparthejd! Nezaobilazna
obaveza države Bosne i Hercegovine, po pitanju izbornog zakona, povezana je s
ustavnim promjenama koje su važne i nužne za implementaciju postojećih
presuda ESLJP-a. Treba ponoviti, međutim, odluka ESLJP-a da poništi prethodnu
presudu u slučaju dr. Kovačević jeste, prije svega, proceduralnog karaktera
i vrlo je suspektna, to jeste: Sud je pod vrlo, vrlo nejasnim
okolnostima osporio “status” dr. Kovačevića kao aplikanta,
a ne meritum njegovih zahtjeva. To znači da onaj zahtjev za uskraćeno pravo
koje traži dr. Kovačević nije osporen i
da se borba protiv diskriminacije mora nastaviti. Sud nažalost uopće nije
ulazio u sadržaj aplikacije dr. Kovačevića. Važno je, također, da ESLJP nije
imao namjeru niti je pokazao bilo kakvo odstupanje od prethodnih presuda
(Sejdić/Finci, Pilav, Šalaku, Zornić, Pudarić), što znači da ostaju obaveze
implementacije tih presuda za Bosnu i Hercegovinu. Dakle, jasno je da je
ESLJP u predmetu Kovačević ostao na razini proceduralnog i da nije ulazio u
meritum aplikacije. Legitimno predstavljane građana Koje “legitimno predstavljanje” u demokratskom sistemu trebamo smatrati doista legitimnim? Sigurno ne ono koje nam predstavlja HDZ i etnopolitika papagaja koji mu služe. U lažnoj i hinjenoj borbi za Bosnu i Hercegovinu hadezeovska politika etničkog predstavljanja podmeće matricu “plemenskog predstavljanja”, odnosno etnopolitika HDZ nameće koncept predstavljanja i biranja kao stranački (ideološki), etnički, ekskluzivistički i regionalni model predstavljanja. Po matrici HDZ postoji samo jedna “prava stranaka” koja “predstavlja bosanske Hrvate”. To ne može raditi niko drugi nego “prava stranka”, čuvarica biološke “zajednice” i čistih krvnih zrnaca. Svi ostali su izdajnici, poturice ili posrbice, prevaranti, nelegitimni, neidentični. Samo jedan i jedna mogu biti legitimni. Tako se u bosansku zbilju i uši neosvještenih članova idiocracy ubacuje shvatanje da je legitimitet u političkom predstavljanju stranački i da jedna stranka izdaje potvrdu i za etnički i možda sutra za religijski identitet, budući da prerasta u kult i obredoslovlje. Ovdje se mora naglasiti, samo radi prevaranata koji mute društvene procese prema fašistoidnim idejama, da je legalnost izvorište svakog legitimiteta. Neprihvatljivo je i primitivno
podmetanje od strane etnopolitike sporne ideje da politička stranka definira
etnicitet, da se pojavljuje kao njegov vladar, posjednik i usmjerivač.
Ustvari, potpuno je morbidna ideja etnopolitike da se kao osnovna operativna
jedinica političkog djelovanja pojavljuje narod ili jedna narodna grupa.
Otkud to u Bosni? Bosansko povijesno iskustvo nije određeno isključivošću,
ekskluzivističkim pristupom organizaciji društvenog života. Tek odnedavno
“stručnjaci” separiranih egzistencija pokušavaju u Bosnu uvesti model
konsocijacijskog geta. To je tuđmanizam na djelu. Iz toga se pojavljuje
zahtjev da se izborni zakon reducira na etničke grupe i da se izbori provode
unutar etničkih grupa Bošnjaka, Hrvata, Srba i ostalih. Samo “vlasnici”
etničkih grupa mogu biti legitimni predstavnici, a oni koji se osjećaju i
građanima države BiH su nelegitimni. Tako fašizam i aparthejd idu skupa u
svome apsurdnom prostakluku fabricirajući cjeloviti društveni sistem apsurda. U tom sklopu, dakle, apsolutno
je suspektno insistiranje na ekskluzivnom “pravu” jedne političke stranke
(HDZ) da se predstavlja kao jedini zastupnik interesa jednog cijelog naroda i
samoproglašava predvodnikom “evropskog puta”. Stoga je važno podsjetiti na
početak devedesetih godina prošlog stoljeća i zapitati se zbog čega su u
Republici BiH napravljene etničko-religijske stranke (ne nacionale,
državljanske, bosanske) kao ekspoziture Beograda i Zagreba? Zbog čega je
napravljen HVO i Vojska “Rs”? Zašto se te formacije organiziraju i koji su
ima strateški ciljevi? Zašto ne poštuju bosansku nacionalnost i suverenitet?
Nije Tuđman napravio HDZ i HVO da brani Republiku BiH? Samo naivci mogu
zanemariti pitanje o uspostavljanju vojnih i političkih formacija Srbije i
Hrvatske na tlu Republike Bosne i Hercegovine početkom 1990-ih godina. Petokolonaško likovanje Nevjerovatno je s kojim bolesnim
likovanjem i populističkim ushićenjem u javnosti glasnici nekontrolirane
mržnje i stranačke ostrašćenosti napadaju predsjednika Željka Komšića i dr.
Slavena Kovačevića, jer je Evropski sud za ljudska prava osporio “status aplikanta”
dr. Kovačevića. E, ovdje je petokolonaška klika došla na svoje. Sada će ona
da se nagovori i da napokon razbije svaki govor o bosanskoj nacionalnost i
suverenitetu, te da definitivno ustoliči boginju etniju na pijedestal svih
vrijednosti koje je epoha nihilizma u Evropi porušila. Petokolonaška klika ne
spominje i ne želi da zna da ESLJP nije ni dotakao meritum aplikacije dr.
Kovačevića, niti ga interesira priča o diskriminaciji građana i neophodnost
da država Bosna i Hercegovina bude jedna izborna jedinica. Zato oni i dalje
ponavljaju kao sumanuti da “ne smiju Bošnjaci birati Hrvatima člana
Predsjedništva” i naliježu na hadezeovsku pervertiranu naraciju o
homogeniziranom narodu kao glasačkom tijelu. Oni ne žele da građani biraju,
nego narodne grupe ili “plemenske zajednice” svoga vožda ili etnarha. Petokolonaška klika podsjeća dr.
Kovačevića da je on Hrvat! Vidi čuda. Njih ne interesira njegova nacionalnost
Bosanca. Oni još guslaju u epskom Kardelj-Šuvar “nacionalnom pitanju”. Njima
je još uvijek Bošnjak, Hrvat ili Srbin “nacionalnost” u internacionalno
priznatoj državi Bosni i Hercegovini – jedinom izvoru nacionalnosti.
Petokolonaška klika rabulista i ridikula odbija ideju građanskog društva i
demokratske države i besramno podmeće koncept konsocijacije i “suživota” po
hadezeovskom modelu. Oni bi, podijeljeni u geta pod kontrolom “legitimnih
političara” i “sveštenika pravovjerja”, ovjekovječili etnokratiju i
protjerali sve one koji misle drugačije. Petokolonaški
rabulisti podmeću etničku pripadnost kao kriterij aktivnog biračkog prava!
Oni su postali sljedbenici politike etničke “čistoće” koju nameće HDZ,
odnosno patološkog ekskluzivizma u dobu podivljale desnice i islamofobne
histerije. Iz tog perverznog osnova politika susjedne Hrvatske i njen premijer
Plenković “obećavaju” izborni zakon za Bosnu i Hercegovinu po mjeri HDZ-a! HR
Schmidt bi u tom projektu trebao biti ključna poluga. Pritom, petokolonaška
klika ne primjećuje nelogičnost u osporavanju “statusa aplikanta” i
zaboravlja u svom epskom rušilačkom zanosu da je Sud već jednom prihvatio aplikaciju
dr. Kovačevića, koji je bio valjan aplikant, procesuirao je prema svojim
standardima i praksama i nakon toga donio Presudu. Zato treba podsjetiti da
odgovorno i ozbiljno “legitimno predstavljanje” jeste ono predstavljanje koje
proizlazi iz zakonskog okvira i koje osigurava da ni jedan građanin BiH ne
bude diskriminiran ni po kojem osnovu (etničkom, religijskom, regionalnom,
spolnom…). Svoditi političko predstavljanje na etničko-religijsko znači biti
u predvorju fašističke ideje! U demokratiji etničko određenje i pripadnost ne
može imati nikakve veze s aktivnim biračkim pravom građanina. Aplikant pred
ESLJP dr. Kovačević je samo tražio kao stanovnik Bosne i Hercegovine da mu se
omogući aktivno biračko pravo. Najzad, treba podsjetiti,
odgovorni građani nikada neće odustati od Bosne kao političke forme slobodnih
i ravnopravnih ljudi, njezinih državljana, niti zanemariti političko i
kulturno bosanstvo i pluralnu racionalnost bosanskog bića. Nikakva ideologija
velikodržavnog hegemonizma i antibosanskog fašizma ne može pokolebati
bosansku odlučnost i spremnost da se država Bosna i Hercegovina i
građansko društvo brane svim raspoloživim sredstvima. |

is incredible with what sick glee and populist delight in public the
messengers of uncontrolled hatred and party passion attack the member of the
Presidency of BH Željko Komšić and Dr. Slaven Kovačević, because the European
Court of Human Rights has challenged the “applicant status” of Dr. Slaven
Kovačević. Context of discrimination against citizens of BiH It is possible, of course, to list only some basic features of the context in which the process before the European Court of Human Rights in the case of Dr. Kovačević v. BiH is taking place. Before the eyes of the public in which we live, the ethnic ghettoization of Bosniaks, Croats and Serbs is taking place in the narrow space of Bosnia, and this is a dangerous policy of isolationism; cancel culture, pauperization and growing illiteracy of the population are underway; likewise, the process of migration and demographic regression continues, the suicidal reduction of nationality to an ethnic-religious group is taking place, the rationality of Modernity is being rejected and primordiality, primitivism and a pre-political barbaric mentality are being forced upon us. The aggressiveness of Greater Serbian and Greater Croatian hegemonic nationalism is incomprehensible to the Bosnian political subject still immersed in the emptiness of Yugo-nostalgia, which is the great cooking pot of the Bosnian brain. EU politicians continue to tell fairy tales for the naive! Slaven Kovačević, with his application before the European Court of Human Rights (ECHR), stood on the front line against discrimination, injustice, national hegemonists, consociational priests, ethnocrats, pathocrats, idiocrats, vassals and dilettantes of the fifth column mechanism, religious fundamentalists, cynical bureaucracy, egocentric maniacs of the so-called "legitimate representation" and false prophets of the "constituent peoples". Fighting for the rights of all citizens of Bosnia and Herzegovina and mitigating the consequences of genocide and wartime persecution, Dr. Kovačević opened the way and showed the way out of the darkness, but he also discovered numerous guardians of apartheid and discrimination. With this, he directly hit the fortress of Tudjmanism, which has been attacking the Bosnian state framework for decades, reducing the Bosnian state to a provisional "landscape" without significant signs of existence. The case of Kovačević showed that ethnopolitics or the majority of politicians in BiH are not aware of the historical moment in which the state of Bosnia and Herzegovina finds itself. Kovačević demands that every citizen of Bosnia and Herzegovina can elect all members of the BiH Presidency. The Grand Chamber of the ECtHR has announced its operative conclusions in the case of Dr. Kovačević – not the judgment. Paragraph 1 of the operative conclusions states that the applicant before the ECtHR, Dr. Kovačević, “challenged the nature of the indirect elections to the House of Peoples of BiH as established by the Election Law and the imposed provisions of the High Representative from October 2022”. However, this was not Kovačević’s claim in the application at all. Therefore, the statement of the Grand Chamber of the ECtHR does not refer to what is stated in Dr. Kovačević’s application! It seems that the aim is to defame and discredit Dr. Kovačević! What is shown to be important with the court’s dealing with “procedural issues” First of all, it should be noted that in his application, Dr. Kovačević challenged the provisions of the Constitution of Bosnia and Herzegovina (Article 4.1 and Article 5), which prevent citizens from exercising their active right to vote in the elections for the Presidency of Bosnia and Herzegovina and the House of Peoples of Bosnia and Herzegovina. The First Instance Judgment of the ECHR confirmed this fact in August 2023. Agreeing to the evident discrimination of citizens of BiH means that anti-Bosnian forces want to keep the citizens of BiH locked in ethnic division and territorial ghettoization. This is the basis for talking about Serbian and Croatian “territories” in Bosnia in the future, and then, consequently, Bosniak “territories”. There is no need for democracy! In this way, we are not talking about Bosnia as a single state, but about a “tri-national” ghettoized community that annuls its own nationality and reduces it to ethnic-religious groups and their leaders. A citizen has rights only in his ethnic ghetto as a member of one national group and can vote for his ethnic leader there. It is therefore necessary to seek a way out of the Dayton constitutional arrangement and captivity in apartheid. Then, secondly, in the hopes of Tudjmanism, the annulment of the previous judgment in the case of Dr. Kovačević, paves the way for the imposition of “legitimate representation and “electoral law” according to the ethnic-religious model of the HDZ as the definitive political form. In this way, Bosnia is transformed into three separate ethnic republics under the rule of the leaders of the people and becomes dysfunctional. Any criticism of ethnic leaders is declared an unpatriotic act and almost treasonous behavior. The leader is unquestionable! Third, the so-called “international community” (IC), which is a paper tiger and presents itself as the protector of the interests of the state of BiH, will disappear from the horizon in an instant and leave the citizens of BiH in the wind. The OHR is not doing its job properly today and has become an indicator of how the IC feels about the state of Bosnia and Herzegovina. HR Schmidt, in the colonial manner of a maharajah, on October 2, 2022, annulled the Bosniak people and the constitution of BiH for one day in order to open up space/passage for the HDZ’s demand for ethnic division of the state’s territory. It is clear that “this part of Europe” has been left in the wind of fascist projects of hegemony from the neighborhood. In a similar way, the IC left the Bosnians in Srebrenica in 1995 in front of the slaughtering hordes of the war criminal Mladić. Those left in the wind are in great danger! Fourth, it is necessary to develop a project of our own political, economic, scientific and technological, Bosnian self-sufficiency as soon as possible, which will be a response to the European cynical attempt at ethnic division of BiH. That is why the important question of our future is nationality and sovereignty, or rather Bosnian statism. It is likely that domestic political dilettantes and priests of the sultanate will understand that without Bosnian nationality there is no future. The national cultural form in this time must have a national framework in which survival is maintained through the state. This means that religion does not give a nation! Fifth, Croatian politics from Zagreb, led by Plenković's HDZ attitude towards Bosnia, does not hide that it is satisfied with the annulment of the previous verdict and that it is now actively attacking the Election Law of Bosnia and Herzegovina, which will serve the politics of Dragan Čović and the continuation of Tuđmanism in Bosnia. (“With regard to Bosnia and Herzegovina, the key issue is the adoption of electoral reform for the sake of equality of all three constituent peoples, as well as the functionality of the country. The breakthrough that BiH achieved by opening accession negotiations should be an incentive for political actors to implement reforms that are important for a better life for citizens and the acceleration of the integration process,” says Plenković.) Plenković continues to promote Tuđmanism and “legitimate ethnic representation,” trying to freeze Bosnia in a state of ethnopolitics, a “throne-nation” consociational community, which results in ethnic territories and permanent control of Bosnian space by neighboring states, Serbia and Croatia. Fabrication of a new legal situation The ECtHR has established in previous final judgments (Zornić, Pudarić, Pilav, Šlaku and Sejdić-Finci) that the electoral system in Bosnia and Herzegovina is based on ethnic and territorial criteria, and is therefore discriminatory and must be thoroughly amended in accordance with European legal standards. The current operational conclusions of the ECtHR mechanically create a new artificial legal situation that is not at all the subject of Dr. Kovačević’s claim in his application. In this way, with the “big, big, big exception” as a cover for the prepared conclusions, the ECtHR produces a new legal situation that allows the denial of “victim status” and the transformation of Dr. Kovačević into a manipulator, because he did not use domestic “legal remedies”. Now all that is needed is a little logic. If we bear in mind that the ECtHR draws conclusions that have no basis in Dr. Kovačević’s claim Kovačević, then it is quite clear that this is an intention to overturn the case, either in favor of the HDZ, which is leading the entire operation of “caring for BiH” or in the interests of the state of Croatia, which, through VP Schmidt, is trying to impose an “electoral law” and “legitimate representation” of its own measure in BiH. A justified question arises: can Bosnia and Herzegovina enjoy democracy in the full sense of the word like other European states? Perhaps someone thinks that BiH does not need democracy at all – but apartheid! The unavoidable obligation of the state of Bosnia and Herzegovina, regarding the electoral law, is connected with constitutional changes that are important and necessary for the implementation of the existing judgments of the ECHR. It should be reiterated, however, that the decision of the ECHR to annul the previous judgment in the case of Dr. Kovačević is, above all, of a procedural nature and is very suspicious, that is: the Court, under very, very unclear circumstances, challenged the “status” of Dr. Kovačević as an applicant, and not the merits of his claims. This means that the claim for a denied right sought by Dr. Kovačević did not dispute that the fight against discrimination must continue. Unfortunately, the court did not go into the content of Dr.'s application of dr. Kovačević. It is also important that the ECtHR did not intend or show any deviation from previous judgments (Sejdić/Finci, Pilav, Šalaku, Zornić, Pudarić), which means that the obligations to implement these judgments for Bosnia and Herzegovina remain. Therefore, it is clear that the ECtHR in the Kovačević case remained at the procedural level and did not enter into the merits of the application. Legitimate representation of citizens Which “legitimate representation” in a democratic system should we consider truly legitimate? Certainly not the one presented to us by the HDZ and the ethnopolitics of the parrots that serve it. In the false and pretended fight for Bosnia and Herzegovina, the HDZ policy of ethnic representation subverts the matrix of “tribal representation”, that is, the ethnopolitics of the HDZ imposes the concept of representation and election as a party (ideological), ethnic, exclusivist and regional model of representation. According to the HDZ matrix, there is only one “right party” that “represents Bosnian Croats”. This can only be done by the “true party”, the guardian of the biological “community” and pure blood cells. All others are traitors, stooges or pro-Serbs, fraudsters, illegitimate, non-identical. Only one and the same can be legitimate. Thus, the understanding that legitimacy in political representation is party-based is being inserted into Bosnian reality and the ears of the unconscious members of the idiocracy, and that one party issues a certificate for both ethnic and perhaps tomorrow religious identity, since it is growing into a cult and ritualism. Here it must be emphasized, only for the sake of the fraudsters who confuse social processes according to fascist ideas, that legality is the source of all legitimacy. It
is unacceptable and primitive to plant the controversial idea by
ethnopolitics that a political party defines ethnicity, that it appears as
its ruler, possessor and director. In fact, the idea of ethnopolitics that
a nation or a national group appears as the basic operational unit of
political action is completely morbid. Where did this come from in Bosnia?
Bosnian historical experience is not determined by exclusivity, an
exclusivist approach to the organization of social life. Only recently have
“experts” of separated existences tried to introduce a model of
consociational ghetto into Bosnia. This is Tuđmanism in action. From this
emerges the demand that the electoral law be reduced to ethnic groups and that
elections be held within the ethnic groups of Bosniaks, Croats, Serbs and
others. Only the “owners” of ethnic groups can be legitimate representatives,
and those who also consider themselves citizens of the state of BiH are
illegitimate. Thus, fascism and apartheid go together in their absurd
simplicity, fabricating an entire social system of absurdity. In this context, therefore, the insistence on the exclusive “right” of one political party (HDZ) to present itself as the sole representative of the interests of an entire people and to proclaim itself the leader of the “European path” is absolutely suspect. Therefore, it is important to recall the beginning of the 1990s and ask ourselves why ethnic-religious parties (not national, civic, Bosnian) were created in the Republic of BiH as branches of Belgrade and Zagreb? Why was the HVO and the “Rs” Army created? Why are these formations organized and what are their strategic goals? Why do they not respect Bosnian nationality and sovereignty? Didn’t Tuđman create the HDZ and the HVO to defend the Republic of BiH? Only naive people can ignore the issue of the establishment of military and political formations of Serbia and Croatia on the territory of the Republic of Bosnia and Herzegovina in the early 1990s. Fifth Columnist's gloating It is incredible with what sick glee and populist delight in public the messengers of uncontrolled hatred and party passion attack President Željko Komšić and Dr. Slaven Kovačević, because the European Court of Human Rights has challenged the "applicant status" of Dr. Kovačević. Well, here the Fifth Columnist clique has come into its own. Now it will be persuaded to finally break any talk about Bosnian nationality and sovereignty, and to definitively enthrone the goddess ethnicity on the pedestal of all values that the era of nihilism in Europe has destroyed. The Fifth Columnist clique does not mention and does not want to know that the ECHR did not even touch the merits of Dr. Kovačević's application, nor is it interested in the story of discrimination of citizens and the necessity for the state of Bosnia and Herzegovina to be a single electoral unit. That is why they continue to repeat like crazy that “Bosniaks must not elect a member of the Presidency from Croats” and fall for the HDZ perverted narrative of a homogenized people as a voting body. They do not want citizens to elect, but national groups or “tribal communities” of their leader or ethnarch. The Five Column clique reminds Dr. Kovačević that he is a Croat! See the miracles. They are not interested in his nationality as a Bosnian. They are still playing around with the epic Kardelj-Šuvar “national question”. For them, a Bosniak, Croat or Serb is still a “nationality” in the internationally recognized state of Bosnia and Herzegovina – the only source of nationality. The Five Column clique of rascals and ridiculers rejects the idea of a civil society and a democratic state and shamelessly inserts the concept of consociation and “coexistence” according to the HDZ model. Divided into ghettos under the control of “legitimate politicians” and “priests of orthodoxy,” they would perpetuate ethnocracy and expel all those who think differently. The Fifth Columnist rascals are substituting ethnicity as a criterion for active voting rights! They have become followers of the policy of ethnic “purity” imposed by the HDZ, i.e. pathological exclusivism in the age of the rampant right wing and Islamophobic hysteria. From this perverse basis, the politics of neighboring Croatia and its Prime Minister Plenković are “promising” an electoral law for Bosnia and Herzegovina tailored to the HDZ! HR Schmidt should be a key lever in this project. At the same time, the Fifth Columnist clique does not notice the illogicality in challenging the “applicant status” and forgets in its epic destructive enthusiasm that the Court has already accepted the application of Dr. Kovačević, who was a valid applicant, processed it according to its standards and practices and then issued a Judgment. That's why it should be reminded that responsible and serious "legitimate representation" is the representation that comes from the legal framework and that ensures that no citizen of BiH is discriminated on any basis (ethnic, religious, regional, sexual...). Reducing political representation to ethnic-religious means being in the vestibule of a fascist idea! In a democracy, ethnic identification and affiliation cannot have anything to do with the active right of a citizen to vote. The applicant before the ECtHR dr. Kovačević only asked, as a resident of Bosnia and Herzegovina, to be granted active voting rights. Finally, it should be remembered that responsible citizens will never give up on Bosnia as a political form of free and equal people, its citizens, nor ignore political and cultural Bosnianness and the plural rationality of the Bosnian being. No ideology of big-state hegemonism and anti-Bosnian fascism can shake Bosnian determination and readiness to defend the state of Bosnia and Herzegovina and civil society with all available means. |
